1. Acceptance of Terms

By accessing or using TASbuddy, a service provided by Atomsharp L.L.C. ('we', 'us', or 'TASbuddy')., you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using the Service.

If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. In that case, "you" and "your" refer to that entity.

We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Service. Your continued use after the effective date constitutes acceptance of the revised Terms.

2. Service Description

TASbuddy is an AI-powered platform that assists recruiters and hiring managers in conducting structured technical interviews. The Service includes:

  • Automated technical question generation based on provided job descriptions
  • Real-time interview support and candidate response recording
  • Technical Assessment Reports summarizing candidate proficiency are done by Interviewer and out system with the help of AI.
  • Structured evaluation frameworks to ensure consistency across candidates

The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any feature with reasonable notice.

3. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. The Service is intended for business use by HR professionals, recruiters, hiring managers, and organizations — not for consumer personal use.

By using the Service, you represent and warrant that you meet these requirements and that your use of the Service complies with all applicable laws and regulations in your jurisdiction.

4. Accounts & Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

  • Provide accurate and complete registration information
  • Notify us immediately of any unauthorized access or breach of security
  • Not share your account credentials with any third party
  • Not create multiple accounts to circumvent usage limits or restrictions
  • Use only one account per individual unless explicitly authorized

We reserve the right to suspend or terminate accounts that violate these conditions.

5. Subscriptions & Billing

We offer the following subscription tiers:

Free Tier
$0 / month

Basic access with limited volume usage.

Premium
$29 / month

Premium access with higher volume usage.

Billing Terms
  • Premium subscriptions are billed monthly on a recurring basis
  • You authorize us to charge your payment method on each renewal date
  • All fees are stated in USD and are non-refundable except as required by law
  • We reserve the right to change pricing with 30 days' notice
Cancellation

You may cancel your Premium subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to Premium features through the end of your paid period.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Service to discriminate against candidates based on protected characteristics including race, gender, age, religion, national origin, disability, or any other class protected under applicable law
  • Input false, misleading, or fabricated job descriptions or candidate responses
  • Attempt to reverse-engineer, scrape, or extract data from the Service in an unauthorized manner
  • Use the Service to harass, defame, or harm candidates or any individual
  • Resell, sublicense, or transfer access to the Service to third parties without written permission
  • Interfere with or disrupt the integrity or performance of the Service
  • Use automated bots or scripts to access the Service in ways not permitted by us
  • Upload, post, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
  • Use the Service to promote or provide instructional information about illegal activities, or promote physical harm or injury against any group or individual.
  • Input any data that contains child sexual abuse material (CSAM) or content that promotes terrorism or violent extremism.

Violation of these policies may result in immediate suspension or termination of your account.

We reserve the right to report any content or activity that we suspect violates any law or regulation to appropriate law enforcement authorities, regulators, or other third parties. We may disclose any information necessary to satisfy any law, regulation, legal process, or governmental request.

7. Data & Privacy

Your Data

You retain ownership of all data you input into the Service, including job descriptions and candidate interview responses ("User Data"). By submitting User Data, you grant us a limited, non-exclusive license to process it solely for the purpose of providing and improving the Service.

Candidate Data

You are solely responsible for ensuring you have obtained all necessary consents to collect and process candidate interview data through our platform, in compliance with applicable employment and data protection laws (including, where applicable, GDPR, CCPA, and equivalent regulations).

Data Retention

We retain User Data for as long as your account is active. Upon account deletion, we will delete or anonymize your data within 90 days, except where required to retain it by law.

8. Intellectual Property

The Service, including all software, algorithms, designs, logos, and content created by us, is owned by TASbuddy and protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your internal business purposes during your subscription term.

AI-generated outputs (such as assessment reports and interview questions) produced through the Service are licensed to you for your internal hiring use only. You may not resell, redistribute, or publish these outputs as your own proprietary methodology without our written consent.

9. AI & Evaluation Disclaimer

You acknowledge and agree that:

  • AI-generated question sets and Technical Assessment Reports are recommendations and aids, not definitive conclusions
  • Final hiring decisions rest entirely with you and your organization
  • AI outputs may contain errors, biases, or inaccuracies and should be reviewed critically
  • You are responsible for ensuring that your use of AI-assisted interview tools complies with applicable employment discrimination laws
  • We make no guarantee that the Service will identify the most qualified candidate or predict job performance

10. Warranties & Limitation of Liability

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TASbuddy SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO US IN THE THREE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

Indemnification

You agree to indemnify, defend, and hold harmless TASbuddy and its officers, directors, and employees from any claims, liabilities, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

Either party may terminate this agreement at any time. You may close your account via your account settings. We may suspend or terminate your access immediately if:

  • You breach any provision of these Terms
  • We are required to do so by law or regulatory authority
  • We determine that your use poses a risk to the Service or other users

Upon termination, your right to use the Service immediately ceases. Sections that by their nature should survive termination (including sections on intellectual property, disclaimers, limitation of liability, and governing law) will survive.

Governing Law

These Terms are governed by the laws of the State of North Carolina, United States, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the courts of North Carolina, and you consent to personal jurisdiction there.
